1 This action was filed in the District Court of McIntosh County by Austin Gammel against J.A. Waddle, d/b/a Waddle Butane Company, for property damages and personal injuries resulting from an explosion of a butane gas system on the premises of the plaintiff, which defendant had sold to and installed for the plaintiff at a residence and drive-in barbecue stand a few miles North of Eufaula. A nine-juror verdict was returned for the plaintiff in the sum of $5,000. Defendant has appealed from the judgment based thereon. We shall refer to the parties by name or as plaintiff and defendant as they appeared in the trial court.
